Terms of Service

The terms and conditions of sale contained herein ("TERMS") apply to all sales entered into by and between 123 Graphic Products, LLC., or any division or subsidiary thereof, and any 123 Graphic Products, LLC ("CUSTOMER").

Acceptance
Acceptance by the CUSTOMER named on the front of the invoice of any of the products listed on the front of the invoice shall constitute acceptance by the CUSTOMER of all TERMS and conditions contained herein. In the event that any provision shall be held to be contrary to law, the remaining provisions shall remain in full force or effect.

Place of Performance
Any matters relating hereto shall be interpreted and construed in accordance with the laws of the state of Kansas and venue for any actions arising hereunder shall be had only in Kansas.

Shipping

In-stock items are generally shipped within 24 hours. Out-of-stock items are generally shipped within 2-4 days. Your credit card will not be charged until your merchandise is shipped.

All items are shipped FOB 123 Graphic Products, LLC's warehouse. 123 Graphic Products, LLC will follow CUSTOMER instructions as to method of shipment. Title to items that CUSTOMER orders passes to CUSTOMER at 123 Graphic Products, LLC 'S shipping dock. All insurance and liability for shipments shall be the responsibility of CUSTOMER. 123 Graphic Products, LLC is not responsible for FedEx, UPS or other carrier errors. 123 Graphic Products, LLC will make reasonable efforts to assist CUSTOMER to correct errors that CUSTOMER'S carrier might make. If you are in Alaska, Hawaii or are an International customer special rates apply.

Components
All items are new with factory, pass-through warranty (see WARRANTIES), unless otherwise noted. Consult your Item's factory warranty statement for coverage details. CUSTOMER is responsible for all freight charges.

Payment
All consumables orders must be prepaid unless an account has been established. Hardware/software orders require 50% deposit with the balance of payment due upon delivery. Hardware/software purchase does not imply automatic establishment of customer account.

Customer Satisfaction Pledge
Pledge allows CUSTOMER to return items for credit or exchange only within 30 days. CUSTOMER is responsible for all freight charges. Thirty days is from date of invoice, not when CUSTOMER receives items. CUSTOMER use or abuse will be deducted out of credit given.

Returns & Exchanges
ALL return shipments require a valid 123 Graphic Products, LLC Return Merchandise Authorization (RMA) number prior to shipment, or they will be refused. Items for return must be shipped to 123 Graphic Products, LLC , insured for full value against loss or damage, UPS, FEDEX or other traceable carrier. We cannot accept COD shipments. Any consumables materials claimed as defective being returned must be accompanied with a sample showing defect. RMA numbers are good for 30 days from date of issuance. Items received with expired RMA numbers will be refused.

Do not write on the box. Use a standard shipping label ONLY. Make sure that you write the RMA# clearly on the shipping label, NOT ON THE BOX.

Restocking Fees
A 25% restocking fee may be charged on all items returned for exchange or credit. A 30% restocking fee will be charged on all items returned for credit or exchange if not in their original packing boxes or if their original packing boxes have been defaced or written on or if all accessories and packing materials to the unit are not returned.

Warranties
123 Graphic Products, LLC MAKES NO WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, FOR ANY PRODUCTS SOLD BY 123 Graphic Products, LLC TO CUSTOMER, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT IS LIABILITY ASSUMED FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES RESULTING FROM THE USE OF A PRODUCT. This warranty is in lieu of all other warranties, express or implied, including but not limited to the warranties of merchant ability and fitness for a particular purpose. Province laws may offer other rights in addition to those above. However, 123 Graphic Products, LLC will pass-through to CUSTOMER all manufacturers' warranties that are available to 123 Graphic Products, LLC for up to one year from the date of purchase. CUSTOMER is responsible for all freight charges. 123 Graphic Products, LLC will not issue refunds for defective products, but will, during such one year period make every effort to replace the defective product as soon as possible. 123 Graphic Products, LLC retains the right, but not the obligation, to substitute similar products if the returned product is unavailable. The pass-through warranty obligations of 123 Graphic Products, LLC set forth herein are contingent upon, and subject to, agreements between 123 Graphic Products, LLC and its manufacturers, which agreements may change from time to time without notice to CUSTOMER.

Entire Agreement
The parties agree that this agreement is the complete and exclusive statement of the mutual understanding of the parties and that this Agreement supersedes and cancels all previous written and oral agreements and communication relating to the subject matter of this Agreement.
